DESCRIPTION

We will discuss a wide range of hot topics in employment law, including the recent uptick in religious accommodation cases since the U.S. Supreme Court decision Groff v. DeJoy; the current state of the Pregnant Workers Fairness Act, the NLRB’s limitations on non-disparagement and confidentiality clauses in severance and settlement agreements; DEI Programs in the wake of SFFA v. Harvard; and AI in employment law.

We have applied to the Idaho State Bar
for 1.0 MCLE credit
for this course.

GUEST SPEAKERS

Emma Nowacki is a Partner at Duke Evett PLLC in Boise.  She specializes in employment, civil rights, professional malpractice, and commercial litigation. She has tried many cases to verdict, including most recently a malpractice case resulting in no liability for her client. Prior to joining Duke Evett, Emma worked as a Deputy Attorney General in the Civil Litigation Division of Office of the Attorney General for the State of Idaho. As a Deputy Attorney general, she defended state agencies in employment and civil rights litigation. Emma began her career as a prosecutor in Chicago where she tried over 15 jury trials and over 100 bench trials.  Emma is on the Board of the Idaho Association of Defense Counsel.

 

Leslie Hayes is a Deputy Chief Administrative Hearing Officer, who joined the OAH on November 15, 2022. Prior to coming to the OAH, she spent ten years with the Office of the Attorney General in the Civil Litigation Division, representing the Idaho Division of Human Resources.  Prior to joining the Attorney General’s Office, Ms. Hayes worked in private practice in insurance defense and clerked for the Idaho Supreme Court. Ms. Hayes has represented clients in all Idaho state courts, the United States District Court for the District of Idaho, the Western District of Washington, the Ninth Circuit Court of Appeals and the United States Supreme Court.
