Making Effective Use of Construction Experts in Adversarial Matters (1.0 CLE Hour)*
Focused and interactive discussion with participants to provide an understanding of: various kinds of construction experts and their qualifications, common investigative techniques, considerations for dealing with the so-called battle of the experts, and ways for both the attorney and expert to assist in preparing for litigation. Gain a better understanding of how construction experts relate to Idaho and Federal Rule of Evidence 702 and how to utilize experts for the benefit of their client throughout various stages of dispute management and resolution ranging from non-litigated early case assessment, informal settlement negotiations, mediation, deposition, and trial.

Crystal Uebelher is an insurance lawyer who is passionate about elevating the expertise of lawyers and insurance professionals. She strives to improve the insurance industry by providing creative approaches to educating professionals on the ever-changing issues in our industry. As the owner of Clarity Education and Consulting, LLC, she creates meaningful educational experiences for insurance agents, lawyers and claims professionals and also works as a Senior Claims Attorney.
Ms. Uebelher is the primary liaison between the property and legal teams. Her focus is working with local counsel to defend the carrier and its insured in a variety of litigation. She also works directly with claims professionals to find the best solution to complex claims. Her role includes consulting with the underwriting department to develop and update coverage forms. She earned her juris doctorate in 2007 from the University of Wisconsin Law School (magna cum laude, Order of the Coif) and her Certified Property Casualty Underwriter designation in 2017.

Steven Boyd is a formerly licensed general contractor and a registered professional engineer in multiple states, He has a diverse experience in construction, design, and engineering including civil construction, underground utilities, foundations, framing, steel, concrete, building envelopes, interior and exterior finishes, roofing systems, HVAC & more, and fire sprinkler and plumbing systems on commercial and residential projects. He is also experienced in the standard of care for general contractors, construction managers, owner representatives, and subcontractors.
In addition, Mr. Boyd has extensive experience in all phases of conceptual planning, design, and construction. As a subcontractor, general contractor, and owner’s representative, he has managed, supervised, and coordinated the construction of commercial, governmental, retail, educational, healthcare, industrial, and residential structures across a range of project delivery mechanisms including plan and spec, design-build, design-assist, and negotiated scopes of work.
Bruce Hedin, Ph.D.
Dr. Bruce Hedin is a leading expert in the assessment of the effectiveness of advanced search and analytics technologies at performing legal tasks. At H5, where, until its recent acquisition, he served as Principal Scientist, his responsibilities included the design and oversight of sampling and measurement protocols to validate the results of AI-enabled review technologies (such as TAR). Dr. Hedin also supports counsel engaged in meet-and-confer discussions regarding the use of TAR.
Dr. Hedin is a frequent writer and speaker on the role of sampling and measurement in applying AI-enabled technologies to legal challenges. He has also contributed to initiatives, at US NIST, at the IEEE, and at the WEF’s Centre for the Fourth Industrial Revolution, that seek to ensure that, to the extent AI is adopted in the service of the law, it is done so on the basis of an informed trust.
Dr. Hedin earned his Ph.D. from Stanford University and his B.A. from Cornell University.
